Acceptance of Terms
By accessing or using CatalogPDF ("CatalogPDF", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.
Description of Service
CatalogPDF provides software for creating catalogs and related documents. The service may include free and paid features, as well as account-based features such as saved projects, stored content, subscriptions, workspace or organization features, and other functionality we may introduce over time.
Some features may process data locally in your browser, while other features may involve storing or syncing data through our systems or our service providers.
Accounts
You may need to create an account to use some features of the service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information and to keep it up to date. If you believe your account has been compromised, you should contact us promptly.
Subscriptions, Billing, and Payments
Some parts of the service may require a paid subscription or other paid access.
You agree to provide current, complete, and accurate billing information where required. Payments are processed by third-party payment providers, and we do not store full payment card details on our own servers.
Unless otherwise stated, fees are non-refundable except where required by law. If the service offers recurring subscriptions, you authorize us and our payment providers to charge the applicable recurring fees until cancellation takes effect under the applicable billing terms.
Use of the Service
You agree to use the service only in compliance with applicable law and these Terms. You may not:
- use the service for unlawful, fraudulent, harmful, or abusive purposes
- upload, create, store, or share content that infringes intellectual property, privacy, publicity, or other rights
- interfere with, disrupt, probe, or misuse the service or its infrastructure
- bypass rate limits, access controls, or security protections
- use bots, scrapers, or automated systems in a way that unreasonably burdens the service or accesses it beyond permitted use
- reverse engineer, decompile, or attempt to extract source code or underlying components of the service, except to the extent such restrictions are prohibited by applicable law
- use the service to transmit malware, spam, or other harmful code or materials
User Content
You retain ownership of the content you upload, create, store, or otherwise submit through the service ("User Content").
However, you grant CatalogPDF a limited, non-exclusive, worldwide, revocable right to host, store, process, transmit, and display your User Content only as necessary to operate, maintain, secure, improve, and provide the service to you and your organization or workspace, if applicable.
You are responsible for ensuring that you have all rights necessary for your User Content and that your User Content does not violate these Terms or applicable law.
Intellectual Property
The service, including its software, code, design, text, branding, logos, features, and overall look and feel, is owned by CatalogPDF or its licensors and is protected by intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the service or its content.
Analytics and Product Improvement
We may collect and use usage data, diagnostics, error reports, and product interaction information to operate, maintain, secure, analyze, and improve the service and develop new features. Our handling of personal information is described in our Privacy Policy.
Third-Party Services
The service may rely on third-party providers for hosting, infrastructure, authentication, analytics, error monitoring, customer support, storage, communications, and payment processing. Your use of certain third-party services may also be subject to their separate terms and privacy policies.
Termination and Suspension
We may suspend or terminate your access to all or part of the service at any time, with or without notice, if:
- you violate these Terms
- your use creates security, legal, or operational risk
- we suspect fraud, abuse, or unauthorized activity
- payment is overdue for paid features, where applicable
- we are required to do so by law
You may stop using the service at any time. Termination does not affect rights or obligations that by their nature should survive termination.
Disclaimer of Warranties
To the maximum extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the service will be uninterrupted, secure, error-free, or free from harmful components, or that any content or output will be accurate, complete, or reliable.
Limitation of Liability
To the maximum extent permitted by law, CatalogPDF and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities, arising out of or related to your use of or inability to use the service.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the service will not exceed the greater of:
- the amount you paid to CatalogPDF for the service in the 12 months before the event giving rise to the claim, or
- USD 100
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.
Indemnification
You agree, to the extent permitted by law, to indemnify and hold harmless CatalogPDF and its affiliates, officers, employees, agents, suppliers, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your User Content
- your misuse of the service
- your violation of these Terms
- your violation of any law or the rights of a third party
Changes to the Service
We may modify, update, suspend, or discontinue all or part of the service at any time, with or without notice.
Changes to These Terms
We may update these Terms from time to time. If we do, we will post the updated version and revise the "Last updated" date. By continuing to use the service after the updated Terms take effect, you agree to the revised Terms.
Governing Law
These Terms are governed by applicable law, without regard to conflict of law principles, unless otherwise required by mandatory law.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
